These Terms of Use govern your use of the public website of H&S Staffing Co (“H&S,” “we,” “us,” or “our”). By using the website, you agree to these Terms. If you do not agree, please do not use the website.
01Purpose of the Website
H&S provides staffing information and allows employers, candidates, and other visitors to communicate with the company. H&S currently supports contract and contract to hire staffing, with technology as the current specialty.
Using the website does not by itself create employment, a staffing agreement, a placement agreement, an agency relationship, or any other contractual relationship between you and H&S.
02No Guarantee
Contacting H&S, providing information, submitting a résumé, or discussing a staffing need does not guarantee an interview, a candidate submission, a job opportunity, employment, a placement, a candidate match, a staffing engagement, or any hiring outcome.
03Employer and Staffing Inquiries
An inquiry does not require H&S to accept an engagement, and H&S may decline any inquiry. Commercial arrangements between H&S and a client are governed by separate written agreements.
The public website does not establish staffing fees, markups, payment terms, conversion fees, contract to hire conversion periods, guarantees, employment classifications, payroll responsibility, or any other commercial terms.
04Candidate Information
If you provide professional information about yourself, you represent that the information is accurate to the best of your knowledge and that you have the right to provide it.
Providing information does not create employment and does not require H&S to represent you for any opportunity.
05Candidate Approval
H&S will not submit a candidate’s profile or résumé to a client for a particular opportunity without first informing the candidate about the opportunity and receiving the candidate’s approval for that submission.
Before representing a candidate for an opportunity, H&S discusses the compensation associated with that opportunity.
Approval for one opportunity does not automatically authorize submissions for unrelated opportunities.
06Staffing Engagements
H&S may support contract and contract to hire arrangements. The website does not establish employment classification, payroll responsibility, employer of record status, independent contractor status, conversion fees, conversion periods, markups, payment terms, guarantees, client obligations, or candidate employment terms.
Where applicable, those matters are addressed in separate written agreements.
07Screening
Depending on the opportunity, screening may include résumé review, recruiter screening, technical screening, internal technical interviews, work authorization or eligibility review, role specific qualification against the client brief, reference checks when appropriate or required, and background checks when appropriate or required.
Not every opportunity will involve every screening step.
If a background check or other consumer report requires a separate disclosure, authorization, or notice under applicable law, that process will be provided separately. Providing information to H&S through the website does not by itself authorize H&S to obtain a consumer report or background check.
08Website Information
Information on the website is provided for general informational purposes. We may change, update, or remove content at any time without notice. Content on the website is not legal, tax, employment, or professional advice.
09Acceptable Use
You agree not to use the website to:
- Break any applicable law or regulation
- Submit false, misleading, or fraudulent information
- Submit information about another person without the right to do so
- Send unsolicited commercial messages or spam
- Introduce malicious code or interfere with the operation of the website
- Attempt to gain unauthorized access to any system or account
- Collect information from the website by automated means without our permission

15Privacy
Information submitted through the website is handled in accordance with our Privacy Policy, which forms part of your use of the website.
16Separate Agreements
Where H&S and a client, candidate, or other party enter into a separate written agreement, that agreement governs the subject matter it covers. Nothing on the public website modifies a separate written agreement, and a separate agreement may contain its own governing law and dispute resolution provisions.
17Governing Law
These Terms and your use of the public website will be governed by the laws of the State of California, without regard to its conflict of law principles, except where applicable law requires otherwise.
You agree that the state and federal courts located in California will have jurisdiction over any dispute arising out of or relating to these Terms or the public website, except where applicable law requires otherwise. Separate staffing or commercial agreements may contain their own governing law and jurisdiction provisions.
18Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the Effective Date at the top of the page. Continued use of the website after an update indicates that you are aware of the current Terms.
